不法滞在者を一律除外に 外国人の国保適用対象から

 不法滞在の外国人をめぐる医療問題で、厚生労働省は、国民健康保険法の施行規則を改正し、在留資格のない外国人などが国保に加入できないことを明文化する。8日から施行し、国保の運営者である全国の市町村に周知徹底する。

 現行法令に不法滞在者などを除外する明文規定がないことから、最高裁は1月の判決で「安定した生活を継続して営んでいる」など一定の条件下なら、加入の余地を認める初判断を示していた。これに対し、厚労省は「保険料徴収が困難」といった自治体の意見も踏まえ、制度の安定性を確保するため、一律に除外することをあらためて明確に打ち出すことにした。

 最高裁判決を受け、同省は2月以降、東京都など自治体からの意見聴取も含め、例外的な加入要件を設けることが可能かどうか、検討してきた。(共同通信)

国民健康保険:不法滞在外国人を全面排除 厚労省が明文化

 外国人の国民健康保険適用について厚生労働省は、在留資格がなければ加入を認め ないと法令に明文化することを決めた。不法滞在の外国人は一律で適用除外となる。

 在留資格のない外国人は保険料の徴収が困難なケースが多く、厚労省は国保加入を 認めていなかった。だが日本に22年住んでいた台湾籍の男性を巡る訴訟で最高裁が 今年1月「不法滞在の外国人を排除する法規定はない」と指摘し加入の余地を認め、 同省は新たな法整備を検討していた。新たな施行規則では(1)入管法上の在留資格 がない(2)在留期間が1年未満(3)外国人登録をしていない−−のいずれかに該 当すると加入できない。

 外国人問題に詳しい大貫憲介弁護士は「個別の事情を勘案して加入を認めていた市 町村もあり、門戸を狭める対応だ」と批判している。【清水健二】

Illegal foreigners in Japan to be barred from nat'l insurance plan

Foreigners staying illegally in Japan will be unable to join the national health insurance scheme starting from Tuesday, Health, Labor and Welfare Ministry sources said Monday.

The ministry will revise the implementation regulations for the national health insurance law to state that foreigners without permission to stay in Japan will be excluded without exception from the insurance plan, the sources said.

The ministry will inform municipalities around the nation, which actually operate the insurance plan under the guidance of prefectural governments, about the revision, which takes effect Tuesday, they said.

The move comes in response to a Supreme Court ruling in January that said foreigners without valid residency status should be allowed to join the insurance plan under certain conditions as there were no clear provisions barring them.

Starting in February, the ministry consulted local governments, who complained about the difficulties anticipated in collecting insurance fees from such foreigners, and decided to exclude them from the insurance scheme, the sources said.

The ministry determined it was impossible to include foreigners staying illegally in Japan because those who are normally subject to deportation do not fit into the insurance system and because it is difficult to come up with and confirm the enrollment requirements for them, the sources said.

Under the new implementation regulations, those who do not possess Japanese nationality and who either have no valid residency status, who are permitted to stay in Japan for less than one year, or who have not registered with local authorities as foreign residents will be barred from the insurance scheme, they said.

However, those who are initially permitted to remain in Japan for less than a year but are definitely planning to extend their stay for a total period of more than a year will not be excluded.

On Jan. 15, the top court said it was illegal to deny a South Korean-born Chinese man who has lived in Japan since 1971 coverage under the health plan, ruling for the first time that it was illegal to bar all foreigners without valid residency permits from the program.

It said illegally-staying foreigners who have registered with local governments as foreign residents, have applied for special permission to stay in Japan, and are likely able to continue living stably in Japan are eligible to join the insurance plan.

There are an estimated 250,000 foreigners staying illegally in Japan.
